Welcome to Triclicks (“we,” “us,” or “our”) official website (the “Site”). These Terms of Use (the “Agreement”) govern your access to and use of our services, including the Site, online products, mobile-compatible features, and any related content or software (collectively, the “Services”). By accessing or using the Services—whether as a registered user or guest visitor—you confirm that you have read, understood, and agree to be bound by this Agreement, as well as our Privacy Policy (incorporated herein by reference).

PLEASE READ THESE TERMS CAREFULLY. THIS AGREEMENT INCLUDES A MANDATORY ARBITRATION PROVISION, A CLASS ACTION WAIVER, AND A JURY WAIVER. THESE PROVISIONS REQUIRE YOU TO RESOLVE DISPUTES WITH TRICLICKS THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN THROUGH COURT PROCEEDINGS OR CLASS ACTIONS.

We reserve the right to update, revise, or modify this Agreement at any time in our sole discretion. When we make changes, we will: (i) post the revised Agreement on this page; (ii) update the “Last Modified” date at the bottom of the page; and (iii) notify you of material changes via a prominent banner on the Site or an email to your registered address (if applicable). Your continued use of the Services after changes are posted constitutes your acceptance of the revised Agreement. If you do not agree to the updated terms, please cease using the Services immediately. This Agreement applies to all visitors, users, and others who access the Services (“Users”).

You represent and warrant that: (a) you are at least 18 years of age, or if under 18, you are an emancipated minor or have obtained legal parental/guardian consent; (b) you have the legal capacity to enter into this Agreement; and (c) your use of the Services complies with all applicable laws, regulations, and this Agreement.

You agree not to use the Services for any illegal, unauthorized, or fraudulent purpose, including but not limited to: (i) violating copyright, trademark, or other intellectual property rights; (ii) transmitting viruses, worms, or destructive code; (iii) accessing or attempting to access secure areas of the Site without authorization; (iv) using automated tools (e.g., “robots,” “spiders”) to scrape content or overload our servers; (v) harvesting or collecting personally identifiable information of other Users; (vi) impersonating another person or entity; (vii) posting abusive, defamatory, offensive, or unlawful content; or (viii) interfering with the proper functioning of the Services.

The Services enable Users to browse, search for, and purchase Triclicks-branded products, apparel, and related items (the “Products”). We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only. This license does not include: (a) commercial use, resale, or exploitation of the Services or content; (b) copying, reproducing, distributing, or modifying Site content without our express written consent; (c) framing or linking to the Site without prior authorization; or (d) using the Services to promote third-party products or services.

Our Site is hosted on a secure e-commerce platform that facilitates product sales and service delivery. We reserve the right to refuse service to any User for any reason at our sole discretion.

You agree to pay all fees associated with your purchases, including product prices, shipping costs, and applicable taxes. By placing an order, you authorize Triclicks and our third-party payment processors to charge the provided payment method (e.g., credit card, debit card) for the total amount due. It is your responsibility to provide accurate, current billing information (including contact details, payment method, and expiration dates) and update this information promptly if it changes.

All product prices are displayed in United States Dollars (USD) and are subject to change without prior notice. We strive to ensure price accuracy, but we reserve the right to correct errors, inaccuracies, or omissions—including after an order is submitted. We may also limit the quantity of Products per order or per User and terminate product offerings at any time.

Tangible Products are shipped FOB Shipping Point. Title and risk of loss pass to you upon shipment from our warehouse or authorized fulfillment partner. Shipping fees are the User’s responsibility unless “Free Shipping” is explicitly offered at checkout. All shipping costs are disclosed prior to purchase.

Products may be returned or exchanged within 30 days of delivery, provided they are in their original, unused condition (with tags intact and packaging unopened). Custom or special-order Products are non-returnable unless defective. To initiate a return: (i) contact us at service@triclicks.com for return instructions; (ii) ship the Product to the designated address (you bear return shipping costs unless the return is due to a defect or our error); and (iii) allow 5–7 business days for processing after we receive the return.

We will issue a refund, replacement, or store credit (at our discretion) for qualifying returns. If you do not receive your order, contact us within 30 days of the shipping confirmation, and we will either resend the order at no cost or provide a full refund. All billing discrepancies must be reported within 30 days of appearing on your account statement; failure to do so waives your right to dispute the charges.

All content on the Site—including text, graphics, logos, images, videos, software, and trademarks (collectively, “Content”)—is the exclusive property of Triclicks or its licensors and is protected by international copyright, trademark, and intellectual property laws. Except as explicitly permitted by this Agreement, you may not use, reproduce, or distribute any Content without our prior written consent.

Certain areas of the Site may allow Users to post comments, reviews, feedback, or other content (“User Content”). You retain ownership of your User Content but grant Triclicks a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, and distribute the User Content in connection with the Services and our business (e.g., marketing, product improvements). This license terminates within a reasonable time after you delete your User Content, though we may retain server copies for backup purposes.

You are solely responsible for your User Content and warrant that it does not infringe third-party rights (e.g., intellectual property, privacy) or violate applicable laws. We are not liable for any loss or damage arising from User Content and reserve the right to remove content we deem objectionable, unlawful, or in violation of this Agreement.

Any unsolicited ideas, suggestions, or feedback you submit to Triclicks (e.g., product improvements, service enhancements) are considered gratuitous and non-confidential. We may use these ideas without additional compensation to you and are not obligated to keep them confidential.

The Site may contain links to third-party websites, services, or tools (e.g., social media platforms, analytics providers). These third parties have independent terms of service and privacy policies, and we have no control over their content or practices. We are not liable for any loss or damage resulting from your interaction with third-party sites. You access these links at your own risk and should review the applicable terms of the third party before engaging with their services.

We may also offer access to optional third-party tools (e.g., product customization features). These tools are provided “as is” without warranties or endorsements, and we disclaim all liability for their use.

This Agreement remains in effect while you use the Services. We may terminate or suspend your access to the Services at any time, without notice or liability, if you violate this Agreement or engage in conduct we deem harmful to the Services or other Users. Upon termination, your license to use the Services ends, but all provisions of this Agreement that by their nature survive (e.g., intellectual property, indemnification, liability limitations) will remain in effect.

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. TRICLICKS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRICLICKS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS. THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR OTHER LOSSES, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT PROHIBIT THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless Triclicks, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of this Agreement or applicable laws; (c) your User Content; (d) unauthorized use of your account; or (e) your infringement of third-party rights.

This Agreement, together with our Privacy Policy, constitutes the entire understanding between you and Triclicks regarding the Services and supersedes all prior or contemporaneous communications (oral or written). A printed version of this Agreement shall be admissible in judicial proceedings to the same extent as electronic records.

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
